近日，国家网信办联合国家发展改革委、教育部、科技部、工业和信息化部、公安部、广电总局公布了《生成式人工智能服务管理暂行办法》，自2023年8月15日起施行。

《办法》旨在规范和促进生成式人工智能服务健康发展，防范生成式人工智能服务可能带来的风险，让生成式人工智能技术更好地造福人民。

• 第五条：

推动生成式人工智能基础设施和公共训练数据资源平台建设。促进算力资源协同共享，提升算力资源利用效能。推动公共数据分类分级有序开放，扩展高质量的公共训练数据资源。鼓励采用安全可信的芯片、软件、工具、算力和数据资源。

Article 6 We encourage the independent innovations in fundamental technologies of generative artificial intelligence, including algorithms, frameworks, chips, and supporting software platforms, international exchanges and cooperation on an equal and mutually beneficial basis, and formulation of international rules related to generative artificial intelligence.

We will promote the construction and development of generative artificial intelligence infrastructure and public data resources platforms used for training. We promote the collaboration and sharing of computing power resources to enhance the utilization efficiency of computing power resources. We promote orderly disclosure of public data by classification and grade to achieve high quality public data resources for training. We also encourage the use of safe and reliable chips, software, tools, computing power and data resources.

• 第九条：

提供者应当依法承担网络信息内容生产者责任，履行网络信息安全义务。涉及个人信息的，依法承担个人信息处理者责任，履行个人信息保护义务。

提供者应当与注册其服务的生成式人工智能服务使用者（以下称使用者）签订服务协议，明确双方权利义务。

Article 9 Providers shall bear the liability as producers of network information contents and fulfill the obligations of network information security in accordance with the law. Where personal information is involved, they shall bear the liability as processors of personal information and fulfill the obligations of personal information protection.

Providers shall sign a service agreement with the users who register for their generative artificial intelligence services (hereinafter referred to as "Users") to specify the rights and obligations of the two parties.

提供者应当明确并公开其服务的适用人群、场合、用途，指导使用者科学理性认识和依法使用生成式人工智能技术，采取有效措施防范未成年人用户过度依赖或者沉迷生成式人工智能服务。
